These Website Terms of Use (these “Terms”) govern your access to and use of the digital surfaces operated by Middle Tennessee Trailer Rentals, LLC (“MTTR,” “we,” “us,” “our”), including:

  • the website at midtntrailerrentals.com and any subdomains;
  • the help site at help.midtntrailerrentals.com;
  • the short-link and QR redirect service at mtt.rent; and
  • our live chat, email, SMS, and phone support channels (collectively, the “Sites”).

By accessing or using any Site, you agree to these Terms. If you do not agree, do not use the Sites.

1. Relationship to the Rental Agreement

These Terms govern your use of the Sites. They do not govern the rental of a trailer.

The rental of any trailer offered by MTTR is governed exclusively by the MTTR Trailer Rental Agreement (the “Rental Agreement”), the published fee schedule, and the published cancellation policy, in each case as in effect at the time of booking. If anything in these Terms conflicts with the Rental Agreement with respect to a trailer rental, the Rental Agreement controls for that rental.

A current copy of the Rental Agreement is available for review on the booking platform and is presented for acceptance before any booking is completed.

2. Eligibility

You must be at least eighteen (18) years of age to use the Sites for the purpose of booking a rental. Children under the age of thirteen (13) may not use the Sites. By using the Sites you represent that you meet these age requirements and that you have the legal authority to enter into these Terms.

3. Privacy

Your use of the Sites is also governed by our Privacy Policy, which describes how we collect, use, and share information. The Privacy Policy is incorporated into these Terms by reference. A current copy is available at midtntrailerrentals.com/privacy.

4. Acceptable Use

You agree to use the Sites only for their intended purposes — researching, booking, and managing trailer rentals; obtaining customer support; and accessing our help content. You agree not to:

  1. use the Sites in any manner that violates any applicable law or regulation;

  2. attempt to gain unauthorized access to any account, system, or network associated with the Sites;

  3. probe, scan, or test the vulnerability of any system or network, or attempt to breach any security or authentication measure;

  4. introduce any virus, malware, or other harmful code to the Sites;

  5. interfere with or disrupt the Sites, the servers or networks on which they run, or the experience of other users;

  6. impersonate any person or entity, or misrepresent your affiliation with any person or entity;

  7. collect or harvest information about other users, including by scraping, automated data collection, or unsolicited contact;

  8. use the Sites to send spam, chain letters, or other unsolicited communications;

  9. use the Sites to transmit unlawful, defamatory, harassing, abusive, threatening, or otherwise objectionable content;

  10. reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the Sites or any content on the Sites, except as expressly permitted by these Terms;

  11. use the Sites to develop or train any machine-learning model, artificial-intelligence system, or competitive product or service, except by express written permission from MTTR; or

  12. use any robot, spider, scraper, or other automated means to access the Sites for any purpose without our express written permission.

We may refuse service, terminate accounts, remove content, or cancel bookings, in our reasonable discretion, for any conduct that we believe violates these Terms or that we believe is harmful to other users, to MTTR, or to third parties.

5. User Content

The Sites allow you to submit content through live chat, contact forms, booking forms, review prompts, and similar features (your “User Content”). User Content includes the messages you send through chat, the photographs and information you submit at booking and during a rental, and any reviews or feedback you submit.

(a) Your responsibility. You are solely responsible for your User Content. You represent that you have all rights necessary to submit it and that it does not violate any law or any third-party right.

(b) License to MTTR. By submitting User Content, you grant MTTR a worldwide, non-exclusive, royalty-free, sublicensable, perpetual license to use, copy, modify, display, and distribute the User Content for the purpose of (i) operating the Sites, the booking platform, and our trailer rental service; (ii) defending against claims; (iii) marketing the service, but only for User Content that you have separately consented to be used for marketing (for example, by submitting a public review); and (iv) any other purpose for which the User Content was reasonably provided.

(c) Removal. We may, but are not obligated to, remove any User Content at our discretion. We may retain copies of User Content as needed to comply with legal obligations, defend claims, or operate the service.

(d) Feedback. If you send us suggestions or feedback about the Sites or our service, you agree that we may use that feedback without restriction or compensation.

6. Booking Through the Sites

The Sites display trailer availability, pricing, and booking flows operated by our third-party booking platform. Display of a trailer or price on the Sites is an invitation to book, not an offer. A binding rental contract is formed only when:

  1. you have completed the booking flow on the booking platform;

  2. you have accepted the current version of the Rental Agreement, the fee schedule, and the cancellation policy; and

  3. MTTR (acting through the booking platform) has confirmed the booking.

Prices, availability, and trailer specifications may change between display and confirmation. The terms governing your rental are those in effect at the time MTTR confirms the booking.

7. Intellectual Property

(a) Site content. The Sites and their content — including text, graphics, logos, images, photographs, video, software, and the selection, arrangement, and design of those elements — are owned by MTTR or its licensors and are protected by United States and international copyright, trademark, and other intellectual-property laws.

(b) Limited license. Subject to your compliance with these Terms, MTTR grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Sites for personal, non-commercial purposes related to researching, booking, or managing a trailer rental.

(c) Trademarks. “Middle Tennessee Trailer Rentals” and the MTTR logos and marks are trademarks of MTTR. You may not use any MTTR trademark without MTTR’s prior written permission. Third-party trademarks displayed on the Sites are the property of their respective owners.

(d) Help content. The articles and resources published on the help site at help.midtntrailerrentals.com are made available to current and prospective renters for personal reference. You may link to public help articles. You may not republish, mirror, or scrape the help content without our prior written permission.

The Sites integrate with and link to services provided by third parties, including our booking platform, identity-verification provider, payment processor, live chat provider, hosting provider, analytics provider, and others described in our Privacy Policy. Each third-party service operates under its own terms and privacy policy. We are not responsible for the practices of those third parties, and your use of any third-party service is at your own risk.

Links to external sites are provided for convenience. The presence of a link does not constitute endorsement.

9. Disclaimers

THE SITES, THEIR CONTENT, AND ALL FEATURES PROVIDED THROUGH THE SITES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, MTTR disclaims all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, and freedom from defects, errors, viruses, or harmful components.

Without limiting the foregoing, MTTR does not warrant that:

  1. the Sites will be uninterrupted, error-free, or available at any particular time;

  2. the information on the Sites (including pricing, availability, and trailer specifications) is accurate, complete, current, or free from error; or

  3. any defect in the Sites will be corrected.

Nothing on the Sites — including the help articles and any descriptions of the trailer, its capabilities, or its operation — constitutes legal, financial, insurance, mechanical, towing, or other professional advice. Tow-vehicle compatibility, hitching, insurance coverage, and lawful operation of the trailer are the responsibility of the renter as described in the Rental Agreement.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent any disclaimer in this Section is unenforceable in your jurisdiction, the remainder of these Terms remains in full force and effect.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MTTR AND ITS MEMBERS, EMPLOYEES, AGENTS, AND LOT PARTNERS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITES, whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not MTTR has been informed of the possibility of such damages.

MTTR’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO YOUR USE OF THE SITES (AS DISTINCT FROM LIABILITY ARISING OUT OF A TRAILER RENTAL, WHICH IS GOVERNED BY THE RENTAL AGREEMENT) IS LIMITED TO ONE HUNDRED UNITED STATES DOLLARS (US$100).

The limitations in this Section do not apply to liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless MTTR and its members, employees, agents, and lot partners from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Sites; (b) any User Content you submit; (c) your violation of these Terms; (d) your violation of any law or third-party right in connection with your use of the Sites; or (e) any misrepresentation you make to MTTR through the Sites.

This Section does not apply to any matter governed by the Rental Agreement, including any indemnification by the renter under Section 22 of the Rental Agreement, which is separately enforceable.

12. Termination and Suspension

We may suspend or terminate your access to all or part of the Sites at any time, with or without notice, for any reason, including suspected violation of these Terms or suspected fraudulent, abusive, or unlawful conduct. Sections of these Terms that by their nature should survive termination — including Sections 5(b), 7, 9, 10, 11, and 13 through 21 — survive any termination.

If your access is terminated, you may not re-register or attempt to access the Sites through another account or means without our express written permission.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms shall be the state or federal courts located in Robertson County, Tennessee, and you consent to personal jurisdiction in those courts, subject to Section 14.

14. Arbitration of Disputes Under $10,000

For any dispute, claim, or controversy arising out of or related to your use of the Sites where the amount in controversy is $10,000 or less, you and MTTR agree that the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in Robertson County, Tennessee, or by remote proceeding. Either party may instead bring eligible disputes in the small-claims court of Robertson County, Tennessee.

This Section does not apply to (a) any matter governed by the Rental Agreement, which has its own dispute-resolution clause; (b) claims for injunctive or equitable relief; (c) actions to enforce intellectual-property rights; or (d) any matter that applicable law makes non-arbitrable. Disputes exceeding $10,000 in amount proceed in the courts identified in Section 13.

You and MTTR each waive any right to participate in a class action or representative proceeding under these Terms.

15. Force Majeure

Neither party is liable for delay or failure to perform under these Terms to the extent caused by events beyond that party’s reasonable control, including acts of God, severe weather, natural disaster, fire, flood, civil unrest, government action, embargo, pandemic, road closure, or failure of utilities, hosting providers, or communications infrastructure. The affected party shall use reasonable efforts to resume performance.

16. Assignment

You may not assign or transfer these Terms or any rights or obligations under them. We may assign these Terms to any successor in interest, including in connection with a sale, merger, or reorganization of MTTR.

17. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later.

18. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect. The invalid provision shall be construed to the maximum extent permitted by law to give effect to the parties’ intent.

19. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of these Terms reflects the most recent change. If we make material changes, we will provide prominent notice on the Sites. Continued use of the Sites after the effective date of an update constitutes acceptance of the updated Terms.

20. Entire Agreement

These Terms, together with the Privacy Policy and (with respect to any trailer rental) the Rental Agreement, the fee schedule, and the cancellation policy, constitute the entire agreement between you and MTTR with respect to your use of the Sites and supersede all prior discussions, representations, and understandings.
